TERMS AND CONDITIONS Revision:  4/19/2005 Terms and conditions subject to change at any time without notice - please visit this location often for updated information Locality  - These terms and conditions are subject to the laws and regulations of the state of Texas, and the United States of America.  All applicable state, federal, or local laws will supersede any information contained in this terms and conditions. Product - Leads4Agents.com, LLC provides information of individuals, families, and children who placed health insurance inquires on the Internet.  Guarantee - Leads4Agents.com, LLC does not guarantee any sale of insurance or related products from the information we provide.  Liability - Leads4agents.com, LLC assumes no liability for the information contained on our site, from the products you potentially sell, or any other liability form the information we provide.  It is the agents responsibility to conform to all applicable state, local, and federal laws. Licensed Agent - We only sell information to LICENSED AGENTS - at any time we may require proof that you hold a license in the state you request to purchase leads.  We do not sell our leads to 'discount plans' or providers of non-licensed insurance products.  It is YOUR responsibility to maintain your state or federal licensing and you agree to sell ONLY in states which you hold a valid license. Acceptable Contact - You agree not to contact any lead purchased outside of the hours of 9AM - 9PM (the local time of the lead) or as regulated in THE LEAD'S STATE.  Please note most states or localities regulate when you can contact a potential client.  We require you do not contact prior to 9AM or after 9PM - OR AS OUTLINED IN THE LEAD'S RESPECTIVE STATE. DO NOT CALL LIST - As a licensed state insurance agent, and since the client provided their phone number in an inquiry to obtain health insurance - you generally may contact the customer within 90 days of their original contact request (usually 24 hours or less when entered to our system).  You hereby agree to not contact a customer, if they request no further contact.  Please note - it is YOUR responsibility to conform with your state and federal do not call list(s).  We assume NO liability for DO NOT CALL related claims or issues and we DO NOT GIVE ADVICE on DO NOT CALL LIST regulations. SPAM - You may email the LEAD ONE health insurance quote or comparison information.  You are not authorized to continuously email the potential customer or LEAD.  Any addition to your 'mailing list' must be opt-in or double opt-in.  All email communication with our LEADS must contain the following information:  YOUR NAME, MAILING ADDRESS, PHONE, EMAIL, STATE LICENSE NUMBER (IF REQUIRED BY YOUR STATE), and removal instructions DISCLOSURE OF OUR SERVICE - You are not authorized to tell the LEAD or potential client where you purchased their information.  A generic statement such as "I purchased your information from one of the websites you typed in your information..." or "one of our affiliate websites provided us your information..."  You are not permitted to state LEAD was purchased form LEADS4AGENTS.COM - unless specifically required until state, local, or federal law.  Violation may result in account termination without notice. REFUNDS - Under no circumstance is a refund of payment for leads acceptable.  We will not refund credit cards, or other form of payment.  Please note if you DISPUTE any charge - we will ask that you refrain from using our service in the future. CREDITS - We give credit for bad phone, uninsurable, and other conditions if returned within 7 days and following our current exchange policy.  We reserve the right to limit exchanges to a percentage of your monthly budget to prevent abuse. Setup Fees - Setup fees are non-refundable if applicable. Initial Deposit - Initial deposit is used to purchase leads, a refund of unused balance will be issued if account is cancelled.  Refund of unused credit balance to be paid via check, money order, or credit card refund within 45 days.  Cancellation - All cancellations must be in writing and faxed to 1-928-752-1198.  Email or phone cancellations will not be accepted.  No refunds for service complaints, only potential refund is any unused pre-paid deposit balance.  You may cancel at any time, however should you decide to utilize service in the future - new setup fees, prices, and terms and conditions may exist. Exclusive Lead - Definition:  Lead is sold to a  maximum of one agent - you hereby acknowledge their is no such thing as a truly exclusive lead, and this term is used lightly.  We have no control over what information the LEAD provides to other websites, other agents, local agents, etc.,  Even an exclusive lead may be contacted by an agent outside of our control - EXCLUSIVE means we only sell the lead ONE TIME Non-Exclusive Lead - Definition:  Lead is sold to a maximum of 3 other agents (plus yourself).  One of the agents the lead is sold or provide to may be an affiliate, agent, owner, or related entity of LEADS4AGENTS.COM,LLC affiliated companies, agents, or related insurance provider.  We do not compete with our agents on most leads, however in certain markets - it is possible that a non-exclusive lead purchases may also be worked by an affiliate, agent, owner, or related entity of LEADS4AGENTS.COM, affiliated companies, agents, or related insurance provider. Lead Quantity - We will do our best to satisfy your your requests, however the amount of lead volume we deliver is not guaranteed and may vary based on our availability and other market conditions. Price Guarantee - We reserve the right to change lead pricing at any given time - we will do our best to notify customers in advance of any such potential change, but we are not required to do so.  Lead pricing, format, and terms and conditions subject to change due to market conditions and without notice.  Lead Delivery - Leads will be emailed to your email address specified.  We are not responsible for Internet connectivity issues with your / our service provider.  You may login anytime at leads4agents.com and view past lead purchases.  Delivery of leads via email is for your convenience - but please be advised that email services can have reliability problems.  We recommend you login to your account and compare to information you have been emailed. Required Information - We require the following information for a lead to be valid:  Name (first, last or first & last), Address, City, State, Zip code, Phone Number (one or two), Email address, Gender & age (or date of birth) of at least one potential applicant.  Leads will be distributed for child only, individuals, individuals & spouse, families, smokers, non-smokers, and a variety of other medical variables, etc.,  We do not offer health filters (unless specified) and do not require any fields other than what is listed.  Basic information (in order for YOU to run a quote) is provided - all other fields are optional at all times, and format subject to change without notice.  There are no refunds on leads, and every lead subject to current terms and conditions of leads4agents.com Sale, Transfer, Discloser of Lead - TRANSFERRING, DISCLOSING, OR SELLING OUR LEADS TO OTHER ENTITIES IS STRICTLY PROHIBITED AND VIOLATORS WILL BE PROSECUTED.  ANY SALE OF OUR LEAD TO THIRD PARTIES IS STRICTLY PROHIBITED AND LEGAL ACTION WILL BE TAKEN ON THOSE WHO VIOLATE THIS POLICY.  EXCEPTION:  Users who purchase leads and distribute to THEIR agents (of their agency or company) - this is allowed.  DISTRIBUTION OF LEAD TO MULTIPLE STATE LICENSE HOLDERS - OR SELLING OUR LEADS TO MULTIPLE STATE LICENSE HOLDERS IS A STRICT VIOLATION OF OUR TERMS AND CONDITIONS - SUBJECT TO LEGAL ACTION. DEFINITIONS:  AGENT, USER - An agent/user is someone who is purchasing LEADS from LEADS4AGENTS.COM.  LEAD -  a LEAD is someone who entered information online in an attempt to receive a health insurance quote or be contact by an AGENT. WARRANTY:  no warranty, expressed, written or otherwise is provided - LEADS4AGENTS.COM, it's owners, affiliates accept NO REFUNDS, and NO LIABILITY to any product or information provided.  ALL INFORMATION IS AT YOUR OWN RISK - and you agree to hold LEADS4AGENTS.COM, LLC it's owners, affiliates, or related parties harmless to any REFUND, or LEGAL claims made based on the information provide from our services. This agreement subject to the laws and information of the State of Texas and the United States of America - if any portion is found to be not valid - it does not void this agreement in it's entirety.
